EMAIL AND MARKETING
By using this application, you are agreeing to receive occasional email marketing from G4 By Golpa
USER CONTENT LICENSE
By posting User Content to any part of the Application, you automatically grant, and you represent and warrant that you have the right to grant, to the G4 BY Golpa a non-exclusive, transferable, sub-licensable, royalty-free, fully-paid, worldwide license to use, copy, reformat, translate, excerpt (in whole or in part) and distribute such User Content for the sole purpose of performing the G4 BY Golpa Services in accordance with any settings you may select. You may remove User Content from the Application at any time, at which time the license granted herein for such User Content shall terminate. G4 BY Golpa may retain archived copies of your User Content as part of G4 BY Golpa’s standard backup procedures.
G4 BY Golpa does not assert any ownership over your User Content; rather, as between us and you, subject to the rights granted to us in this Agreement, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content. Notwithstanding the foregoing, distribution and sharing of your User Content will be subject to the settings you select.
G4 BY Golpa has the right, in our sole and absolute discretion, to pre-screen or delete any User Content that is determined to be inappropriate or otherwise in violation of this Agreement.
By uploading your User Content to the Application, you hereby authorize G4 BY Golpa to grant to each end user, as indicated by settings that you select, a personal, limited, non-transferable, perpetual, non-exclusive, royalty-free, fully-paid license to access your User Content for their internal purposes and not for distribution, transfer, sale or commercial exploitation of any kind.
DISCLOSURE OF INFORMATION
G4 BY Golpa will disclose user information when we believe disclosure of information is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our G4 BY Golpa, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Terms of Use or other agreements or policies, in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.
SUBMISSIONS
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Application or the G4 BY Golpa Services (“Submissions”) provided by you to G4 BY Golpa are non-confidential and G4 BY Golpa (as well as any designee of G4 BY Golpa) shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
THIRD PARTY APPLICATIONS AND CONTENT
The Application contains (or you may be sent through the Application or the Company Service) links to other Applications (“Third Party Applications”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software and other content or items belonging to or originating from third parties (the “Third Party Content”). Such Third Party Applications and Third Party Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Applications accessed through the Application or any Third Party Content posted on, available through or installed from the Application, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Applications or the Third Party Content. Inclusion of, linking to or permitting the use or installation of any Third Party Application or any Third Party Content does not imply approval or endorsement thereof by us. If you decide to leave the Application and access the Third Party Applications or to use or install any Third Party Content, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any Application to which you navigate from the Application or relating to any applications you use or install from the Application. Any purchases you make through Third Party Applications will be through other Applications and from other companies and Company takes no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party.
